ERISA, or the Employee Retirement Income Security Act of 1974, was passed by Congress to ensure that employees receive the pension and other benefits promised by their employers, and to encourage employers to provide benefits to their employees. The law is now generally interpreted to cover most employer-provided benefits, including health insurance and long term disability benefits.

If you are like most Americans today, you receive your health insurance through a welfare benefit plan, which is governed by ERISA. ERISA also covers employer-provided life insurance and long term disability (LTD) benefits. ERISA takes priority over any state laws governing these types of claims.

When Your Claim Has Been Denied

When your health or long term disability insurance claim is denied, you must go through an administrative process before you can file a lawsuit. I have extensive experience helping people work deal with claims administrators. I know from experience that you must exhaust all your administrative remedies before you can take your claim before a federal judge.
